1. About these terms

This website, www.indalkp.com ("the Website"), is owned and operated by INDAL KP, a sole proprietorship registered under Udyam Registration No. UDYAM-BR-26-0131252, with its registered office at Behind MIG-185, Hanuman Nagar, Kankarbagh, Patna Sadar, Patna – 800020, Bihar, India ("we", "us", "our", "the Studio").

By accessing the Website, browsing it, buying a product, booking a service or subscribing to a plan, you ("you", "the Client") agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not use the Website.

We may update these terms from time to time. The version published on this page at the moment of your purchase is the version that applies to that purchase.

2. What we offer

The Studio provides creative services and digital goods, including but not limited to:

2D animation and motion design
Character design and concept art
Illustration and visual development
Video editing and post-production
Digital downloads such as brushes, templates, presets, guides and reference packs
Paid memberships, subscriptions and course-style content
One-to-one consultations and reviews booked through the Website

Not every offering is available at all times. Availability, scope and price are as stated on the relevant product, service or booking page at the time of purchase.

3. Eligibility

You must be at least 18 years old, or be using the Website under the supervision of a parent or legal guardian, and be legally capable of entering into a binding contract under the Indian Contract Act, 1872.

4. Accounts

Some parts of the Website require an account. You are responsible for keeping your login details confidential and for all activity that takes place under your account. Tell us immediately at indalkp@gmail.com if you believe your account has been used without your permission.

We may suspend or close an account that is being used fraudulently, abusively, or in breach of these terms.

5. Pricing and payment

All prices are displayed in Indian Rupees (INR / ₹) and are inclusive of applicable taxes unless stated otherwise on the product page.
INDAL KP is not currently registered for GST, as turnover is below the statutory threshold. No GST is charged and no GST invoice is issued. Should we become GST-registered, prices and invoices will be updated accordingly and this page revised.
Payments are processed through Razorpay, a third-party payment aggregator authorised by the Reserve Bank of India. We do not collect, see or store your card number, CVV, UPI PIN or net-banking credentials at any point.
We reserve the right to change prices at any time. A price change never affects an order already placed and paid for.
If a price or product description is published in error, we may cancel the affected order and refund you in full. We will contact you before doing so.

6. Orders and acceptance

Your order is an offer to buy. A contract is formed only when we send you an order confirmation by email, or when access to the purchased item is granted, whichever happens first.

We may decline or cancel an order where:

The item is unavailable or was listed in error
Payment was not authorised or was later reversed
We reasonably believe the order is fraudulent
The brief falls outside what we can deliver to a professional standard

In each case any amount already paid is refunded in full.

7. Custom creative work

Where you commission bespoke work, the following applies in addition to the rest of these terms.

Brief and scope. Work begins from a written brief agreed by email or through the Website. Anything not in the agreed brief is out of scope.

Advance payment. Custom projects normally require an advance of 50% of the quoted fee before work starts, with the balance due before final files are released. Project-specific terms in a written quotation override this clause.

Revisions. Each project includes the number of revision rounds stated in the quotation. Where none is stated, two rounds of revisions are included. Further revisions are billed at the then-current hourly rate.

Turnaround. Delivery dates given in a quotation are estimates made in good faith. Delays caused by late feedback, late payment or changes to the brief extend the timeline correspondingly.

Client materials. You confirm that any brief, script, reference, logo, font, image, audio or other material you supply is yours to use, or that you hold the necessary licence. You indemnify us against any third-party claim arising from material you supplied.

Portfolio rights. Unless you tell us otherwise in writing before the project is delivered, we may display the completed work in our portfolio, on social media and in showreels. If the work is confidential or subject to an embargo, say so in writing and we will honour it.

8. Intellectual property

Our content. All material on the Website — artwork, animation, illustration, text, layout, logos, downloadable files and code — is owned by INDAL KP or licensed to us, and is protected under the Copyright Act, 1957 and applicable international treaties.

Digital products. Buying a digital product grants you a non-exclusive, non-transferable, worldwide licence to use it. Unless the product page says otherwise:

You may use it in personal and commercial projects of your own.
You may not resell, redistribute, share, sublicense or upload it to any file-sharing, template or stock library, whether free or paid.
You may not claim authorship of the underlying asset or register it as your own trademark or copyright.

Commissioned work. Ownership of bespoke work transfers to you on receipt of full and final payment, except for underlying tools, rigs, brushes, source templates and reusable techniques, which remain ours. Working files and project sources are supplied only where the quotation says so.

Reporting infringement. If you believe material on the Website infringes your rights, email indalkp@gmail.com with details of the work, the URL complained of, and confirmation that you are the rights holder or their authorised agent.

9. Acceptable use

You agree not to:

Use the Website for any unlawful purpose or in breach of any Indian law
Copy, scrape, mirror or systematically extract content from the Website
Attempt to gain unauthorised access to the Website, its servers or any connected system
Upload malware, or anything designed to interfere with the Website's operation
Post content that is defamatory, obscene, hateful, harassing, or infringes anyone's rights
Impersonate any person or misrepresent your association with any person or organisation

We may suspend or terminate access for breach of this clause, without refund where the breach is material.

10. Third-party links and services

The Website links to third-party platforms including Upwork, YouTube, Instagram and others. We do not control those platforms and are not responsible for their content, policies or practices. Any dealings you have with them are between you and them.

11. Disclaimers

The Website and its content are provided "as is". While we take reasonable care to keep information accurate and the Website available, we do not warrant that:

The Website will be uninterrupted, timely or error-free
Any defect will be corrected within a particular time
Content, tutorials or guidance will produce any specific commercial or creative result

Any educational or advisory content is provided for general information and is not professional, legal or financial advice.

12. Limitation of liability

To the fullest extent permitted by Indian law, our total liability arising out of or in connection with any order, product or service is limited to the amount you actually paid us for that specific order, product or service.

We are not liable for indirect, incidental, special or consequential loss, including loss of profit, loss of business, loss of goodwill or loss of data, however caused.

Nothing in these terms excludes liability for fraud, wilful misconduct, or any liability that cannot lawfully be excluded.

13. Force majeure

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including power failure, internet or hosting outage, hardware failure, natural disaster, epidemic, civil unrest, strike, or any act of government.

14. Indemnity

You agree to indemnify and hold harmless INDAL KP, its proprietor and its contractors against any claim, loss, damage, liability or expense (including reasonable legal fees) arising from your breach of these terms, your misuse of the Website, or material you supplied to us.

15. Termination

We may suspend or terminate your access to the Website or to any purchased content, with or without notice, if you materially breach these terms. Clauses relating to intellectual property, limitation of liability, indemnity and governing law survive termination.

16. Governing law and jurisdiction

These terms are governed by the laws of India. The courts at Patna, Bihar have exclusive jurisdiction over any dispute arising out of or in connection with these terms or your use of the Website.

In compliance with the Information Technology Act, 2000 and the Consumer Protection (E-Commerce) Rules, 2020:
